Antenuptial Contracts in South Africa: Why They Matter

Getting married is an exciting chapter, but it also has serious legal and financial consequences. One of the most important steps couples can take before tying the knot is signing an antenuptial contract (ANC). This legal agreement determines how assets and debts will be managed during the marriage  and what happens if the marriage ends through death or divorce.

What is an Antenuptial Contract?

An antenuptial contract is a written agreement signed by both partners before marriage, and it must be registered at the Deeds Office within three months of being signed.

By default, South Africans who marry without an antenuptial contract are married in community of property, meaning all assets, debts, and liabilities are shared equally, regardless of who acquired them.

Types of Antenuptial Contracts

  1. ANC with Accrual
  • Each spouse keeps ownership of their own pre-marital assets.
  • Assets acquired during the marriage are considered part of the “accrual” and shared at divorce or death.
  • Fair for couples who want independence but still share in the growth of the marriage.
  1. ANC without Accrual
  • Each spouse retains full ownership of their own estate, before and during the marriage.
  • No sharing of growth or accrual.
  • Suitable for couples where one partner already has substantial assets or wants strict financial independence.

Why Sign an Antenuptial Contract?

  • Asset protection – shields one spouse from the other’s debts.
  • Financial clarity – clear rules on property, savings, and investments.
  • Business protection – keeps business interests separate from marital property.
  • Flexibility – couples can tailor terms to suit their unique needs.

The Legal Process of an ANC

  1. Consult an attorney – only a notary public may draft and register an antenuptial contract.
  2. Drafting the contract – the terms are agreed and set out in writing.
  3. Signing before marriage – both parties must sign in front of the notary.
  4. Registration – the notary registers the contract at the Deeds Office within three months.

What If You Don’t Sign One?

If you don’t sign an antenuptial contract, your marriage will automatically be in community of property. This means:

  • All assets and debts are jointly owned.
  • Both spouses are liable for each other’s financial decisions.
  • Creditors can claim against the joint estate.
