Curatorships in South African Family Law

What is a Curatorship?

  • A person has a brain injury or intellectual disability.
  • Someone is unable to manage large financial settlements (for example, children receiving damages from a Road Accident Fund claim).

Types of Curatorships

  1. Curator Bonis
    • Appointed to manage a person’s financial affairs, property, or estate.
    • Often used where a minor or incapacitated person receives a large settlement.
  2. Curator Ad Litem
    • Appointed to assist a person in legal proceedings where they cannot represent themselves.
    • Ensures that their side of the matter is fairly presented to the court.

The Legal Process of Curatorship

  1. Application to Court – usually brought by a family member or interested party.
  2. Medical or expert evidence – provided to confirm the individual’s incapacity.
  3. Court decision – the judge appoints a suitable curator and defines the scope of their powers.
  4. Ongoing accountability – the curator must report to court on their management of affairs.
