The Eviction Process

  1. Notice to vacate
    The landlord must give the tenant written notice to leave the property.
  2. Application to court
    If the tenant refuses, the landlord must apply to the Magistrate’s or High Court for an eviction order.
  3. Court hearing
    Both parties are given a chance to present their case. The court considers factors such as the tenant’s circumstances, length of occupation, and availability of alternative accommodation.
  4. Eviction order
    If granted, the order specifies when the tenant must vacate.
  5. Sheriff enforcement
    Only the sheriff of the court may physically remove a tenant if they do not comply.

  • Lock tenants out without a court order.
  • Cut off electricity or water to force a tenant out.
  • Use threats or force to remove tenants.
